DEFINITIONS

§1

In these terms of use of the www.englishbathroom.com online store, hereinafter referred to as the Terms of Use, the following terms should be interpreted as follows:

Seller ENGLISH BATHROOM limited liability company based in Warsaw (00-389), Juliana Smulikowskiego 4a /16.

Store online store located on the www.englishbathroom.com website and its sub-pages

Client every individual who has signed an agreement with the Seller for opening an account at the Store; the term also refers to an individual who doesnt have an Account and is in the middle of placing an order

Account a Clients account opened by them at the Store in accordance with the provisions defined in the Terms of Use

Consumer an individual defined in the provisions of the article 221 of the Civil Code

 

GENERAL PROVISIONS

§2

The Terms of Use define the rules of the Seller providing services electronically to the Clients, which consist of enabling them to: sign sales agreement over the Internet for the products included in the Stores assortment at the prices provided on adequate sub-pages of the Store and open their Account, as well as use the Newsletter service.

§3

The contents presented on the Stores website, especially announcements, advertisements, price lists and other information, do not constitute an offer as defined by the provisions of the article 66 and 661 of the Civil Code, only an invitation to make offers.

§4

Prices of the products included in the Stores assortment are provided in Polish zloty or Euro and contain VAT. The Seller may make modifications to the Stores assortment, product prices, conduct and cancel promotional events. Such changes have no impact on the sales agreements for individual products already signed with the Clients.

§5

It is only possible to make a purchase at the Store after opening an Account.

§6

Using the Store doesnt require the Clients computer or other device to meet any particular technical requirements. All that is needed is: Internet access, having an e-mail address and a standard operating system and web browser.

Proper use of the Account as well as placing an order require enabling cookie files in the web browser. Cookie files are used to maintain the Clients session after logging into their account and to maintain the process of placing an order. It is possible to subsequently delete them using the adequate options available in the web browser or using other software. Detailed information regarding cookie files is available in provisions § 9 - § 11 of the Privacy and Cookies Policy.

 

OPENING AN ACCOUNT

§7

1)            An individual who wishes to sign an Account opening agreement with the Seller should click the Registration tab on the upper side of the www.englishbathroom.com website. The form that is available there constitutes the Sellers offer directed towards a future Client regarding signing an Account opening agreement.

2)            Then one has to fill out the above form and provide the following: e-mail address, password, telephone number.

3)            When opening an Account, one can already provide the data required whenever an order is placed for a product. After marking the adequate box, one has to fill out the adequate form and provide the following:

for a natural persons Account: first name, last name and address;

for a companys Account, on top of the above, also the company and the NIP number.

4)            It is also possible to provide another shipping address indicated in the form after marking the adequate box.

5)            It is forbidden to fill the form with contents of illegal nature.

6)            To send the form and finalize the registration procedure at the Store, it is required to accept the Terms of Use and the privacy and cookies policy.

7)            Clicking the Open an Account button causes the registration form to be sent to the Seller and is synonymous with the individual opening the Account accepting the Sellers offer mentioned in the provisions of the first point of this paragraph. At that moment, an Account opening agreement is signed between the Seller and the individual who has filled out the registration form.

8)            After signing the agreement, the Seller, in accordance with the provisions of the above point, sends the Client an Account opening confirmation message at the e-mail address provided by them.

9)            If the Client is a Consumer, they are entitled to withdraw from the Account opening agreement, without giving a reason, within 14 days from the day of signing it, which is the moment defined by the provisions of the point seven of this paragraph. For this deadline to be met, it is enough to send the Seller a declaration within that time. The provisions of § 15 pt. 2-4 shall apply accordingly.

10)          An Account may also be opened upon placing an order.

§8

The Seller suggests that the Client is careful about their data used to log into the Store, so that no unauthorized parties obtain the access to that data.

§9

After opening an Account, the Client is able to: edit their data, place orders, add products to the Clipboard.

 

THE NEWSLETTER SERVICE

§10

1)            The form located in the Newsletter field constitutes the Sellers offer directed towards a future Client regarding signing a Newsletter service providing agreement.

2)            An individual who wishes to sign a Newsletter service providing agreement with the Seller should fill out the above form by providing an e-mail address.

3)            Clicking the Save button causes the form to be sent to the Seller and is synonymous with accepting the Sellers offer mentioned in the provisions of the point one of this paragraph. At that moment, a Newsletter service providing agreement is signed between the Seller and the individual who has filled out the form.

PLACING AN ORDER

2)            An individual who wishes to sign a Newsletter service providing agreement with the Seller should fill out the above form by providing an e-mail address.

3)            Clicking the Save button causes the form to be sent to the Seller and is synonymous with accepting the Sellers offer mentioned in the provisions of the point one of this paragraph. At that moment, a Newsletter service providing agreement is signed between the Seller and the individual who has filled out the form.


PLACING AN ORDER

§11

1.            Product selling takes place based on orders placed by the Client. The Client is able to place an order after logging into their Account before placing the order or in the middle of it.

2.            One can place orders through their Account 7 days a week, 24 hours a day.

§12

1)            In order to sign a sales agreement with the Seller, the Client selects products at the Store by clicking the Add to the Cart icon located next to the product they selected. The products in the cart are not ordered yet and the Client is able to add more products to the cart, change the quantity of individual products, remove the products contained in it, and cancel their shopping.

2)            After adding products to the cart, the Client is able to continue shopping by clicking the Continue Shopping icon or proceed to finalize placing an order by clicking the Go to the Cart icon.

3)            After clicking the Go to the Cart icon, the Client proceeds to choose the payment and delivery method. Next to the available delivery and payment methods are displayed their prices. The Total Due box displays the amount that includes the prices of the products added to the cart as well as the price of the selected delivery and payment method. Then one has to click the Next button.

4)            If the Client has an Account, they should log into it using the I Already Have an Account at englishbathroom.com field, if they havent done so before proceeding to place an order and click the Next icon. If the Client doesnt have an Account, they should proceed to open one by clicking the Next icon located in the Its My First Time Here field. Then a form will be displayed with a place to provide an e-mail address, password and phone number. This form constitutes the Sellers offer directed towards a Client regarding signing an Account opening agreement.

5)            Then one has to click the Next button in order to conclude the order. The cart with the products displayed in the summary together with their quantity, prices and the cost of delivery and payment constitute an invitation to place a purchase offer for those products directed to the Client by the Seller.

6)            At this stage of placing an order, one has to also check if its correct and confirm by clicking the Carry Out the Order with the Obligation to Pay button. Clicking the Carry Out the Order with the Obligation to Pay button causes a purchase offer for the products in the cart to be sent by the Client to the Seller.

7)            If the Client has chosen the Account opening option, clicking the Carry Out the Order with the Obligation to Pay button is synonymous with the Client accepting the Sellers offer regarding an Account opening agreement. At this moment an Account opening agreement is signed between the Seller and the Client. The provisions of § 7 pt. 9 of the Terms of Use shall apply accordingly.

8)            The Client is able to correct potential errors in the placed order, to change it or to cancel it by clicking the Change or Back button.

9)            After placing the order, information will be displayed confirming the order being received by the Seller, which causes the Client to be bound by the purchase offer for the products in the cart. The Seller will also send the Client an e-mail containing a confirmation for the order placed by the Client and a summary of its content. The e-mail alone doesnt constitute accepting the Clients offer.

10)          Then the Seller informs the Client in an e-mail sent at the e-mail address provided by the Client in the Account or in the order about whether they accept the offer or are unable to do so. If the Seller notifies the Client about accepting the offer they sent, then at the moment the above e-mail message is sent to the Clients mean of electronic communication in a way that the Client is able to read the content of the e-mail, a sales agreement is signed between the Seller and the Client. If the Seller is unable to accept the Clients offer, they will send them an e-mail informing about refusing to accept the Clients offer and providing the reasons for such decision.

§ 13

1)            An ordered product is delivered to the Client using a method selected by them out of the following: Weight-based delivery

2)            A Client has the following payment methods to choose from: money transfer

3)            Due to the fact that product delivery payment methods, dates and amounts as well as the costs related to the selected payment method depend on the products dimensions, they are defined individually upon placing each order.

4)            The costs related to delivering the products are paid by the Client.

§ 14

 

Orders are accompanied with a sales document complying with the tax laws.

RETURNS AND COMPLAINTS

§ 15

1)            If the Client is a Consumer, they are entitled to withdraw from the sales agreement signed with the Seller, without giving a reason, within 14 days. The time to withdraw from the agreement expires after 14 days from the day when the Client came into possession of the item or when a third party other than the delivery provider and assigned by the Client came into possession of the item. If the subject of the agreement is items delivered in sections or piece by piece, the said time expires after 14 days from the day when the Client came into possession of the last section or piece or when a third party other than the delivery provider and assigned by the Client came into possession of the last section or piece. If the subject of the agreement is many items that are delivered separately, the said time expires after 14 days from the day when the Client came into possession of the last item or when a third party other than the delivery provider and assigned by the Client came into possession of the last item.

2)            In order to use the right to withdraw from the agreement, the Client should notify the Seller about their decision to withdraw from the agreement in form of an explicit statement (such as submitted in writing over traditional mail or e-mail at the Sellers address provided in the provisions of the § 1 sub-point a of the Terms of Use).

3)            The Client may use the agreement withdrawal form template, available at https://englishbathroom.com/index.php?route=account/return/add, although it is not obligatory.

4)            In order to meet the deadline of withdrawing from the agreement, it is enough for the Client to send information on using their right to withdraw from the agreement before the time to withdraw from the agreement expires.

5)            The right to withdraw from the agreement does not apply if the subject of the agreement is: items that upon their delivery, due to their nature, become inseparably tied to other items from the moment of it occurring non-prefabricated items, manufactured according to the consumers specifications or intended to meet their individual needs.

6)            In the event of withdrawing from an agreement, the Store returns the Client all the payments received from them, including the costs of delivering the items (excluding the additional costs arising from a delivery method selected by the Client other than the cheapest regular delivery method offered by the Store), immediately, and in every case no later than 14 days from the day of receiving the Clients statement about withdrawing from the agreement. The Store will return the payments using the same payment methods that were used by the Client during the original transaction, unless the Client explicitly agrees to a different solution; in any event, the Client will not bear any costs related to that return.

7)            The Store may refrain from returning the payments until the moment of receiving the items or until the moment of evidence of its delivery being provided, whichever occurs first.

8)            The Client should send or deliver the item to the Store immediately, and in any event no later than 14 days from the day they informed about withdrawing from the agreement. The deadline is maintained if the Client sends the item within 14 days.

9)            The Client bears the direct costs of the items return.

10)          The Client is only responsible for the decrease of the items value arising from using it in a way other than it was necessary to determine the nature, traits and functioning of the item.

 

§ 16

1)            The Seller informs that they are obliged to deliver an item that is free from flaws.

2)            Complaints related to the services provided electronically by the Seller can be submitted in writing at the Sellers address provided in the provisions of the § 1 sub-point a, at the following e-mail address: info@englishbathroom.com or personally for the record at the Sellers headquarter provided in the provisions of § 1 sub-point a.

3)            A complaint has to include the following: order number (or other data that allows to identify it), contact info of the Client that allows to provide a reply for the submitted complaint as well as description of the occurrence making the basis for the complaint.

4)            The Seller will address the complaint within 14 days from the date of it being received by the Seller.

 

DURATION OF AN ACCOUNT OPENING AGREEMENT

§ 17

An Account opening agreement is signed with the Client for an indefinite period.

                                                      § 18

A Client may at any time withdraw from the Account opening agreement by sending a withdrawal notice at the Sellers address provided in § 1 sub-point a, over e-mail at info@englishbathroom.com or in other form. The Agreement will be terminated with immediate effect.

FINAL PROVISIONS

§ 19

When using the Store and communicating with it, it is forbidden to send contents of unlawful nature.

§ 20
